My H1-B visa expired on June 16, 2007. Extension (I-129) has been filed in May 2007 (before expiration). It has not been approved yet. It's still pending. My LC has been approved on July 09, 2007 and my PD is April 2004. My question is: Can I file concurrently I-140 and I-485? Will my application be rejected or will an RFE be issued?

Yes you can file your 485. Just tell your lawyer not to forget to attach the H1 extension application receipt.

I'm a Jul 02 filer and I received the 485 and 765 notices recently.
However, the PRIORITY DATE cell in receipts for both 485 & 765 is BLANK. Is this the usual practice? Shouldn't my PD be populated on these receipt notices?

Bounce flash is a good idea, but you need 1) a powerful flash, and 2) to keep a good distance from the subject. If you get too close, as I painfully learned from a few rolls of slide film shot over recent trips to visit family, the flash goes up to the ceiling, and comes straight down again, leaving eyes in soft but ugly shadow (fortunately, the rest of the photo was well exposed, so I think it can be rescued in PS).
Flash photography is a lot of complexity for a beginner (I feel like a total newbie at flash, and I think I'm not doing too badly on basic exposure of ambient light with a few years' practice), and even modern ?-TTL flash can screw up if used without the photographer's thought or intervention, though probably not as much as the old-style auto flash that I'm using. Of course, there's an almost foolproof way to do flash - using guide numbers - but who wants to spend ten minutes digging for the calculator to figure out flash exposure for each shot, and then being stuck with one aperture dictated by flash power and subject distance?

You can use the unexpired H-1 visa UNLESS your prior employer has withdrawn the underlying petition in which case the visa is void.

CIR could not even get passed in 06 . 07 and right now economy is down so no hope for it. May be Obama wants to keep hope alive in Hispanic Voters so dems can win election in Nov 2010. Health Care is lagging behind schedule and it is very hard for him to press. How can people support CIR....?
also Hispanic caucus will not allow piecemeal until CIR fails. So I don't see even little ray of hope for recapture. Now left over is admin fixes. God knows what can be done under admin fixes..

RFE and NOID come with a color sheet of paper with your details and some USCIS internal codes for your case. You can respond by yourself and put the sheet on top - this is for the mailroom to handle your case
If we do not use G28 to change representation from current lawyer hired by company, would all the notifications go just to the lawyer?

I see each Attroney has different opinion on PD retaing when previous employer cancel the i140.

Sorry, if this seems off-topic.
I'm on H1B visa and my wife is on H4 visa. We file our taxes as a joint return. My wife is currently studying for MS. She has received in-state tuition fees. We received 1098-T from the university. I'm thiking about getting a lifetime learning credit which will reduce my tax bill. My questions are:
* Are people on H1/H4 allowed to take lifetime learning credit for graduate studies?
* Will this have any negative effect on our greencard in the future?

You can simply use the tuition fees deduction on the front of the 1040 return. It will reduce your adjusted gross income. I have been using it for deducting my sons tuition for three years.

Grand total of EB2 pending: 33850
So, technically all the EB2 applicants should get their GC during the fiscal year of 2011. Even in the situation where no fall down from EB1.
Seems like good news for many and hopefully foir EB3s as well if further fall down of visas occur.
Guess, USCIS should wake up and move the dates faster instead of jungling during last quarter of the fiscal year.
i guess it doesn't count ppl who are waiting. The no of ppl who are not able to file 485 is huge.

Your Employer is wrong. USCIS won't send I-94 in separate mail.
As per my knowledge, One should not start working unless there is I-94 attached to I-797 Approval Notice.
Your wife need to go out of the US and get it stamped before start working.
At POE, the Immigration Officer will issue the new I-94 with valid H1-B Status.
Again I am not an attorney...
Please talk to attorney for further clarifications.

Just a quick note. I used the Box2d Library for this project so this might invalidate my entry... if that's the case I'll have to put all hope in my second entry!
